These Terms of Service (the "Terms") govern your access to and use of Witcat's products, websites, and services (collectively, the "Services"). By using the Services, you agree to these Terms.

1) Recording Policy

Witcat supports lawful learning and collaboration. You are responsible for ensuring that any recording, upload, or sharing through the Services complies with applicable laws and institutional rules.

A. Compliance with Institutional Policies

  • Do not record, upload, or share materials that violate the rules or policies of your school, college, university, employer, instructor, or any applicable organization.
  • You are solely responsible for knowing and following your institution's policies on recording, classroom conduct, and distribution of course materials.

B. Copyright & Permissions

  • Do not record, upload, or share any content protected by copyright unless you have the express permission of the rights holder or a clear legal basis to do so.
  • Copyrighted content includes (without limitation) text, images, slides, problem sets, audio, video, graphics, exams, and other instructional materials.

C. Privacy & Sensitive Conversations

  • Do not record or share private or sensitive conversations, confidential information, or legally protected communications.
  • Comply with applicable privacy and recording laws (e.g., consent and two-party consent requirements) in your jurisdiction.

D. Responsibility & Indemnity

  • You, not Witcat, are responsible for your submissions and conduct on the Services.
  • You agree to defend, indemnify, and hold harmless Witcat, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your recordings, uploads, or sharing of content in violation of laws or policies.

2) License to Access Witcat Content

Subject to your continued compliance with these Terms, Witcat grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use content made available by Witcat through the Services ("Witcat Content") for your own personal, non-commercial educational purposes.

  • You may not access, copy, record, download, scrape, spider, crawl, harvest, or otherwise obtain Witcat Content or Service data through automated means (including scripts, bots, or scrapers) except through features explicitly provided by Witcat or as permitted in a separate written agreement.
  • You may not frame, mirror, mask, or otherwise re-publish the Services or Witcat Content without prior written permission.
  • If you purchase a subscription or license, it is for one individual user only and may not be shared. Witcat may implement reasonable limits to prevent unauthorized use, including caps on time, materials accessed, or devices.
  • Witcat reserves all rights not expressly granted.

3) Fulfillment Policy

A. Refunds

Refunds are available only if you encounter a technical issue that Witcat cannot resolve after you have provided reasonable cooperation. To request a refund, contact us within 30 days of purchase with details of the issue and steps to reproduce it.

B. Delivery

All Services are delivered digitally. Access to subscription features is typically granted immediately upon successful payment. Instructions and confirmations are provided via email.

C. Returns

Because Services are digital, returns do not apply. Review feature descriptions and requirements before purchasing. If you experience a problem, contact support for assistance.

D. Cancellations

You may cancel your subscription at any time through the billing portal or account settings. After cancellation, you retain access to paid features until the end of the current billing period; thereafter, premium access ends.

4) User Content, Copyright & Platform Rules

Witcat respects intellectual property and the learning environment.

A. Prohibited Actions

  • No unauthorized copyrighted content: Do not upload, share, or distribute copyrighted materials without permission.
  • No faculty-generated materials without consent: Do not upload instructor- or institution-created content (e.g., slides, lecture notes, assignments, exam materials) unless you have express authorization.
  • No lecture recordings or verbatim transcripts intended for redistribution: Do not share direct class recordings or verbatim transcripts on the Services unless clearly permitted by rights holders and applicable policies.
  • Follow university/organizational policies: If your institution prohibits certain recordings or sharing—even if legal in your locality—you must comply with the stricter institutional policy when using the Services.

B. Ownership & Licenses

You retain ownership of your lawful content. By submitting content to the Services, you grant Witcat a non-exclusive, worldwide, royalty-free license to host, process, transmit, display, and create derivative works solely to operate and improve the Services.

C. DMCA / Copyright Complaints

Witcat complies with the Digital Millennium Copyright Act (DMCA). To report alleged infringement, email contact@witcatapp.com with:

  1. Your contact information
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the material claimed to be infringing (including its location in the Services)
  4. A statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  5. A statement, under penalty of perjury, that the information is accurate and that you are authorized to act
  6. Your physical or electronic signature

Upon receiving a valid notice, Witcat may remove or disable access to the material and, where appropriate, terminate repeat infringers.

D. Enforcement & Consequences

Violations may result in removal of content, feature restrictions, suspension, or termination of accounts. Witcat may also cooperate with institutions and authorities where appropriate.

5) Honor Code (Academic Integrity)

Witcat is built to support learning, not to replace genuine study or facilitate misconduct.

  • Do not use the Services to cheat, plagiarize, solicit or distribute exam answers, or otherwise engage in academic dishonesty.
  • AI-generated notes, flashcards, quizzes, and summaries are intended to aid comprehension and review—not to substitute for attending class, doing assignments, or independent learning.
  • If we detect misuse, we may remove content, suspend or terminate accounts, and—where appropriate—work with academic institutions to protect integrity.

6) Disclaimers; Limitation of Liability

  • The Services and all Witcat Content are provided "as is" and "as available." Witcat disclaims all warranties, expressed or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • To the maximum extent permitted by law, Witcat will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of the Services.
  • Witcat's aggregate liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid to Witcat for the Service at issue in the 12 months preceding the claim or (b) USD $100.
  • Some jurisdictions do not allow certain disclaimers or limitations; in such cases, those provisions apply to the fullest extent permitted by law.

7) Changes; Contact

Witcat may update these Terms from time to time. If we make material changes, we will provide notice as required by law. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
